1. ACCEPTANCE OF TERMS:

By leveraging and interacting with carlosenrique.dev, including buying or advocating for our products, you consent to comply with our service terms and policies. Should you disagree with any of the stipulated terms, you're prohibited from engaging, accessing, or buying from the Carlos Enrique website. The same prohibition applies to promoting Carlos Enrique's products. The content housed in this website could be safeguarded by appropriate copyright and trademark law.

2. TEMPLATE USAGE LICENSE:

Upon acquisition and utilization of a template, you consent to the ensuing license regulations:

Single Website License: This license entitles a section's use on one solitary website. If required for multiple projects, the section needs to be repurchased for every additional project.

Unlimited Website License: This license permits one person to deploy the section across various websites. Code sharing with other individuals is prohibited. Studios or agencies must acquire one license for every team member who will be using the code or accessing the course.

What’s Not Permissible: Common guidelines and restrictions are as follows: You're not allowed to:

- Market or disseminate any code, tutorial videos, or course content.
- Assert proprietorship of any code, design, styles, or assets.
- Duplicate and offer any sections on a comparable service or store.
- Incorporate any Carlos Enrique code as part of a theme or template being distributed or sold.
- Divulge your Teachable login credentials to another person.

Your use of Carlos Enrique's templates implies adherence to the license issued upon purchase.

3. SHOPIFY COURSE:

When purchasing the "Shopify Course," you agree to the subsequent license rules:

You're not allowed to:

- Share your Teachable login information with another person.
- Disseminate product material links, copies, or PDFs.
- Sell or disseminate any course content.
- Assert ownership of any course material, styles, or assets.

Studios or agencies must acquire one license for every team member that will be using the code or accessing the course. Failing to abide by these rules will result in an immediate suspension of your account without any refunds, a barring of all future purchases, and the possibility of facing legal action.

4. PAYMENT PLANS:

Choosing the option of payment plans legally binds you to an agreement for the full payment of the course. Failure to fulfil a payment will be followed up with three reminders. If a payment has not been made within 15 days, the user will be disqualified from the course and all its benefits with no refund provided. Access to course benefits will not exceed 365 days from the original purchase date. Failure to finalize the course's payment could lead to possible legal proceedings against you.

5. TOOLS:

Purchasing and using Carlos Enrique's Tools (such as the Shopify Kit) means agreeing to the following rules:

You cannot:

- Share your login information with another person.
- Share product material links, copies, or PDFs.
- Sell or distribute any course content.
- Claim ownership of any course material, styles, or assets.

Failing to abide by these rules will lead to an immediate account suspension without any refunds, a blocking of all future purchases, and the potential for legal action to be taken against you.

6. PRODUCT ACCESS:

By using the Carlos Enrique's checkout, you consent to sharing your information to access product materials.

Only the purchaser whose name is on the customer account may log in to the Carlos Enrique school. Passwords act as a technological protection measure and cannot be shared with any other individual. Granting access to the product materials to another person will result in the deletion of the student account with no refund.

Creating multiple accounts using different emails to take advantage of promotional discounts is forbidden and will result in future purchases by that individual being banned.

7. DISCLAIMER:

The materials on Carlos Enrique's website are provided 'as is'. The School offers no guarantees, neither express nor implied, and hereby disclaims and negates all other guarantees, including, without limitation, implied guarantees or conditions of merchantability, fitness for a particular purpose, or non-violation of intellectual property or other infringement of rights. Further, the School doesn't assure or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not guarantee that any of the materials on its web site are accurate, complete, or current. The School may modify the materials contained on its web site at any time without notice. However, the School does not make any commitment to update the materials.

Knowledge of the Shopify platform, CSS, HTML, and Javascript is recommended before adding a Carlos Enrique template to a website. By using Carlos Enrique templates, you recognize and agree that you are coding at your own risk. Carlos Enrique templates and other contributors bear no responsibility for any damages or issues caused to any website through the use of our sections. By using Carlos Enrique templates, you acknowledge and agree that the sections may not work perfectly on every Shopify theme, and that we cannot guarantee that apps will not interfere with the sections. By using Carlos Enrique templates, you acknowledge and agree that the sections may not work perfectly on every screen size. Sections have been tested on desktop screens up to 16" and multiple mobile screen sizes. Larger or irregular screen sizes may require additional CSS to display correctly. Product support is not available for these compatibility issues.

8. INSTALLATION SERVICE:

To receive your installation service, you must provide your email, the Shopify store URL address, the store collaborator 4-digit request code, the exact name of the theme you would like it installed on as it appears in your store, and instructions of where the section should be installed on the page. This must be provided within 30 days of purchase, otherwise, the installation request will expire and no refund will be given. Once all required information is provided, sections will be installed within 2 business days after store collaborator permissions are given. We will never ask for your personal login details to install a section.

9. SUPPORT:

Product support for templates is available within the first 30 days after purchase. During the support period, we can assist with:

- Issues with the original section design.
- Access to your account.

We are unable to assist with:

- Installation or configuration for themes not listed as compatible in the product description.
- Issues or outages on the Shopify platform itself.
- Custom code to modify a Carlos Enrique template or your store.
- Incompatibility issues between apps and the sections.

Support for the Shopify course is available for 365 days from the course purchase through the designated support channels. Replies will be given within 2 business days.

10. RETURN POLICY

Due to the digital nature of our products, we do not offer refunds or exchanges under any circumstances. Requests for refunds related to user error (for instance, failing to fully read a product's description or verify the compatibility of your Shopify theme), conflicting third-party codes, or no longer wanting the product, will not be entertained.

11. AFFILIATE PROGRAM

By participating in the Carlos Enrique's affiliate program, you agree to the terms outlined on the Affiliate Program page and your partner dashboard. If you're uncertain about any of the terms, please contact carlos@carlosenrique.dev before using your affiliate link. Commission fees can change at any time, and a notice will be given via email 14 days prior. Affiliates are not allowed to use their own coupon code, or any other affiliate's coupon code. If coupon abuse is identified, such purchases will be invalidated, and no commission will be paid for these orders. Carlos Enrique reserves the right to remove any individual from the affiliate program at any time, for any reason.

12. CHANGES TO PRODUCTS AND SERVICES

The features and prices of our products are subject to change without prior notice. We reserve the right to modify or discontinue products or services at any time without notifying you. The code for templates may be altered for improvement purposes at any time. We do not take responsibility for preserving copies of previous versions for customer use.

13. JURISDICTION

These terms and conditions are regulated by and construed following the laws of Spain, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location. You agree to indemnify, defend, and hold harmless Carlos Enrique Themes and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
